AZ Federal Judge Upholds Child Abuse ‘Black List’

A Maricopa County federal judge dismissed a legal challenge to Arizona’s Department of Child Safety’s new child abuse blacklist policy.

Recently, a Maricopa County Superior Court judge dismissed the New Civil Liberties Alliance’s challenge to the Arizona Department of Child Safety’s child abuse registry. This database provides a digital collection of child abuse offenders and their names, which would provide employers a resource when performing background checks. The registry has been labeled a ‘blacklist’ by opponents that may contain unsubstantiated reports and charges. The name of any reported offenders may stay on the list for as long as 25 years as well, which could be devastating for the individual. While protecting the lives and well-being of children and minors is top priority, there needs to be a discussion on a better process for putting the names on the list.
